Information pursuant to Articles 12, 13 and 14 of EU Regulation 2016/679

Pursuant to and for the purposes of this Regulation, on the subject of "protection of individuals with regard to the processing of personal data", the Municipality of Gargazzone, as the owner of the processing (hereinafter "Administration" or "Owner"), is required to provide information regarding any personal data collected from the citizen, as "Interested".

The data held by the Owner are collected directly from the interested parties.

Where personal data have not been directly obtained from the data subject, the Data Controller, pursuant to art. 14, letter g) of the Regulation, informs that no automated decision-making processes are in place, including profiling as per art. 22, paragraphs 1 and 4.

All data are processed as part of the normal activities of the Owner, for the management of access and subscriptions to the “Natural Pool”.

In reference to the aforementioned purpose, personal data will be processed in such a way as to guarantee the security and confidentiality, as well as respect for the freedom and dignity of the parties concerned, and may be carried out by means of manual, computer and telematic tools for storing, managing and transmitting data. The processing criteria will be closely related to the purposes stated above.

The provision of data for the above purposes is mandatory. A refusal to provide the data would make it impossible for this Administration to manage the request for access to the facilities of the "Natural Pool". The processing carried out by this Administration for the purpose indicated does not require the consent of the person concerned.

The data of the interested parties may be communicated to the following categories of third parties with headquarters or residence in the European Union, which are also subject to the Regulation:

  • public authorities and/or public administrations as part of the fulfilment of specific legal obligations or on the basis of legitimate measures; administrative or judicial authorities, in the way and with the limitations provided for by law;
  • consultants and/or insurers of the Holder;
  • service providers.

The communication of data to the above-mentioned categories of subjects does not require consent.

The data of the interested parties will be known to the staff authorized by the Owner of the execution of the assignment, as well as its support staff.

Personal data processing and storage period

The processing referred to in this information notice shall have the amount of time strictly necessary to fulfil the obligations imposed on the Data Controller by national and/or supranational laws, as well as by the laws of the countries to which the data may be transferred. For example, personal data will be processed and stored for the entire duration of the contractual relationship and, subsequently, for 10 years, ordinary limitation period.

Rights of data subjects (articles 15 to 22 of the regulation)

Finally, we inform you that Articles 15 to 22 of the Regulations grant the interested parties to exercise specific rights.

In particular, interested parties may obtain from the Owner, in relation to their personal data: access by the data subject (Art. 15); rectification (Art. 16); deletion - oblivion - (Art. 17); restriction to processing (Art. 18); notification obligation regarding rectification or erasure of personal data or restriction of processing (art. 19); data portability (art. 20); right to object (art. 21) and automated individual decision-making, including profiling (art. 22). Interested parties have the right to appeal to the Control Authority.
